TERMS OF SERVICE

1. OVERVIEW
These Terms of Service ("Terms") govern your purchase and use of our products and services, including:
- Physical QR-code enabled shirts sold through our store ("Shirts");
- The digital profile platform accessible through the QR code and associated shirt code ("Profile Service");
- Any related website, mobile application, messaging functionality, profile hosting, storage, and customer support services.
By purchasing a Shirt, creating an account, activating a shirt code, or using any part of the Profile Service, you agree to these Terms.
2. ELIGIBILITY
You must be at least 16 years old, or the minimum age required under applicable law in your jurisdiction, to create and manage a Profile Service account.
If you are under the age of majority in your jurisdiction, you may use the Profile Service only with the consent and supervision of a parent or legal guardian.
You represent that all information provided to us is accurate and current.
3. PRODUCT SCOPE
Each Shirt contains a QR code and a unique four-digit shirt code.
Your purchase includes:
- Ownership of the physical Shirt;
- Access to activate and manage a public profile associated with the shirt code;
- Access to platform features that we make available from time to time.
Purchase of a Shirt does not grant ownership of our software, platform, trademarks, designs, source code, or intellectual property.
Certain digital features may be modified, limited, suspended, or discontinued at our discretion.
4. ACCOUNT REGISTRATION AND OWNERSHIP
Activation of a Shirt requires an authenticated account using our supported authentication system.
Once a Shirt code is linked to an account, that account is considered the profile owner unless otherwise determined by us.
We may require verification before transferring ownership of a profile or Shirt code.
You are responsible for maintaining access to your account credentials.
If you lose access to your account, we may require proof of ownership before restoring access. We are not obligated to restore access where ownership cannot be verified.
We reserve the right to refuse ownership transfers where fraud, abuse, or ownership disputes exist.
5. SHIRT CODES ARE PUBLIC IDENTIFIERS
The four-digit shirt code and QR code are intended to identify a public profile.
They are not passwords, secrets, authentication credentials, or security measures.
Anyone who obtains the shirt code or scans the QR code may be able to view the public profile associated with that code.
Users should not rely on shirt codes for privacy or account security.
6. PUBLIC PROFILES AND VISIBILITY
Profiles created through the Profile Service are intended to be publicly viewable.
You acknowledge and agree that:
- Profile information may be viewed by anyone with access to the profile URL, QR code, or shirt code;
- Search engines or third parties may cache or archive publicly accessible content;
- Previously published content may remain accessible after edits or deletion due to third-party caching;
- Paused or disabled profiles may remain technically addressable for a period of time.
You should not upload sensitive personal information, including government identification numbers, financial information, medical information, passwords, or confidential information.
7. USER CONTENT
You may upload text, photographs, profile information, quiz responses, messages, and other content ("User Content").
You retain ownership of your User Content.
By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to:
- Host;
- Store;
- Process;
- Reproduce;
- Display;
- Format;
- Moderate;
- Distribute;
such content solely for operating, improving, securing, and providing the Profile Service.
This license continues for as long as your content remains on the platform and for any reasonable retention period required for backups, legal compliance, dispute resolution, or security purposes.
8. CONTENT RESPONSIBILITY
You are solely responsible for:
- All content uploaded to your profile;
- Any information presented on your profile;
- Any interactions you encourage through your profile;
- Any messages received or sent through platform features.
We do not endorse, verify, or guarantee the accuracy of user-generated content.
9. ACCEPTABLE USE POLICY
You may not use the Profile Service to create, publish, upload, transmit, solicit, or distribute content that:
- Is illegal;
- Is fraudulent or deceptive;
- Is defamatory;
- Is hateful or discriminatory;
- Harasses, threatens, stalks, or abuses others;
- Promotes violence;
- Infringes intellectual property rights;
- Contains malware or harmful code;
- Promotes illegal products or services;
- Exploits or endangers minors;
- Contains non-consensual intimate content;
- Contains sexually exploitative material;
- Violates privacy rights;
- Facilitates spam or mass solicitation.
These restrictions apply to profiles, messages, images, quizzes, text blocks, and all other platform features.
10. PHOTO UPLOAD RULES
Users may upload only photographs and images they have the legal right to use.
Uploaded images must:
- Be in supported file formats;
- Meet published size and technical requirements;
- Not contain malware or hidden code.
We may remove images that:
- Violate these Terms;
- Infringe intellectual property rights;
- Are unsafe or harmful;
- Are excessively large or technically unsuitable.
We are not responsible for loss of uploaded media.
11. MESSAGING FEATURES
Where enabled, visitors may submit messages to profile owners.
We do not guarantee:
- Delivery;
- Storage;
- Availability;
- Preservation of messages.
Users may not use messaging features for spam, harassment, fraud, threats, unlawful conduct, or abusive behavior.
We reserve the right to filter, review, block, remove, or disable messaging functionality.
12. CONTENT MODERATION
We may investigate any content or account activity.
We reserve the right to:
- Remove content;
- Hide content;
- Disable profiles;
- Suspend accounts;
- Restrict messaging;
- Unlink shirt codes;
- Terminate access to the Profile Service.
We may take such action where we believe content violates these Terms, creates legal risk, threatens user safety, harms our platform, or is otherwise objectionable.
13. DATA HANDLING AND PRIVACY
We collect and process information relating to:
- Account registration and authentication;
- Shirt activation;
- Orders and fulfillment;
- Uploaded content;
- Messaging activity;
- Technical and usage information.

14. SECURITY
You are responsible for safeguarding your account credentials.
No website, application, database, or transmission system can be guaranteed to be completely secure.
We do not guarantee that unauthorized access, data loss, service interruptions, or security incidents will never occur.
15. PURCHASES, SHIPPING, AND FULFILLMENT
Prices, taxes, shipping costs, and delivery estimates are displayed during checkout.
Delivery times are estimates only.
Risk of loss passes to you when the shipment is delivered to the carrier or as otherwise required by applicable law.
If a shipment is lost or arrives damaged, contact us within [X] days of delivery.
Shipping may be limited to specific countries or regions.
16. RETURNS AND REFUNDS
Physical Shirts may be returned only in accordance with our Refund Policy.
Customized, personalized, worn, washed, damaged, or altered Shirts may not be eligible for return except where required by law.
Dissatisfaction with profile views, public engagement, visitor interactions, messaging volume, or digital feature availability does not by itself entitle a customer to a refund for the physical Shirt.
Statutory consumer rights remain unaffected.
17. CODE ACTIVATION AND SUPPORT
If a QR code or shirt code is unreadable, duplicated, incorrectly linked, or fails to activate, contact support.
We may request proof of purchase, photographs, or other verification.
Our sole obligation may be limited to:
- Correcting the activation;
- Relinking the code;
- Providing a replacement code;
- Replacing the Shirt where appropriate.
18. INTELLECTUAL PROPERTY
The Profile Service, software, platform design, branding, logos, graphics, interface elements, and related intellectual property are owned by us or our licensors.
Users retain ownership of their User Content.
No rights are granted except those expressly stated in these Terms.
19. TERMINATION
We may suspend or terminate accounts, profiles, or Shirt-code associations for:
- Violations of these Terms;
- Fraud;
- Chargebacks;
- Security concerns;
- Abuse of the platform;
- Illegal activity.
Termination may result in loss of access to profile content and associated services.
20. DISCLAIMERS
The Profile Service is provided on an "AS IS" and "AS AVAILABLE" basis.
We do not guarantee:
- Continuous availability;
- Uninterrupted operation;
- Error-free functionality;
- Visitor engagement;
- Accuracy of user-generated content;
- Protection from misuse of publicly visible information.
21. LIMITATION OF LIABILITY
To the maximum extent permitted by law, our total liability arising out of or relating to the Services shall not exceed the amount paid by the customer for the applicable Shirt and related services during the twelve months preceding the claim.
We shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.
22. INDEMNIFICATION
You agree to indemnify and hold us harmless from claims, damages, liabilities, losses, and expenses arising from:
- Your content;
- Your use of the Services;
- Your violation of these Terms;
- Your violation of applicable law;
- Your infringement of third-party rights.
23. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of Belgium.
Any dispute arising out of or relating to these Terms shall be submitted to the competent courts of Belgium unless mandatory consumer protection laws provide otherwise.
Nothing in these Terms limits rights granted under applicable consumer protection law.
24. CHANGES TO THESE TERMS
We may update these Terms from time to time.
Material changes will be communicated through the website, application, email, or other reasonable means.
Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
